Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the website at www.parkapp.agency, our applications, and related products and services offered by PARKAPP ONLINE LTD (“ParkApp”, “we”, “us”, or “our”) (together, the “Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. If you use the Services on behalf of a business, you confirm you have authority to bind that business.
1. About ParkApp
Legal name: PARKAPP ONLINE LTD
Company number: 17353531
Registered office: 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom
Email: bnawel248@gmail.com
Jurisdiction: England and Wales
ParkApp develops software and digital services for parking discovery, booking, payment, and related urban mobility features. We may act as a technology platform connecting drivers with parking operators and third-party locations.
2. The Services
The Services may include, now or in the future:
- Website and marketing information about ParkApp;
- Mobile or web applications for finding and paying for parking;
- Tools for parking operators (reporting, integrations, and management features);
- Customer support and account management.
We may add, change, suspend, or discontinue any part of the Services at any time. We will use reasonable efforts to give notice of material changes where practicable.
Parking spaces are often operated by third parties. Where you book parking at a third-party car park or on-street location, that operator’s rules, signage, and local laws also apply. ParkApp is not the owner or operator of most parking locations unless we expressly state otherwise.
3. Eligibility and accounts
- You must be at least 18 years old and capable of entering into a binding contract;
- You must provide accurate, current, and complete information when creating an account or making a booking;
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account;
- You must notify us promptly at bnawel248@gmail.com if you suspect unauthorised access.
We may refuse, suspend, or close accounts where we reasonably believe these Terms have been breached or there is a risk of fraud, abuse, or harm.
4. Parking bookings and sessions
When you use the Services to book or pay for parking:
- Displayed prices, duration, and location details are based on information from operators and systems we integrate with. We strive for accuracy but do not guarantee that all information is error-free or real-time in every case;
- A booking or payment confirmation (including email or in-app receipt) is evidence of your session, subject to operator validation and applicable rules;
- You must comply with car park signage, maximum stay limits, vehicle restrictions, and traffic regulations;
- You are responsible for entering the correct vehicle registration number and session details. Incorrect details may result in parking charges or penalties from operators or authorities, for which you remain responsible;
- Extensions or early termination may be available in-app where supported; otherwise session end times apply as booked or as charged.
5. Fees, payments, and Stripe
Fees for parking and any service charges will be shown before you confirm payment. Prices may include VAT where applicable and will be displayed in the currency stated at checkout (typically GBP).
Payments are processed by Stripe Payments UK Ltd (“Stripe”) or other payment providers we designate. By paying through the Services, you also agree to Stripe’s applicable terms and privacy policy. We do not store your full card details.
You authorise us and our payment providers to charge your selected payment method for:
- Parking fees and operator charges;
- Any disclosed ParkApp service or convenience fees;
- Extensions or adjustments to an active session, where you request them.
If a payment fails, we may cancel or suspend the booking and you may remain liable for parking charges under operator rules.
6. Cancellations, refunds, and chargebacks
Refund eligibility depends on the type of booking and operator policy:
- Before session start: If you cancel in accordance with in-app instructions before the parking session begins, we will process a refund to your original payment method where a payment was taken, unless the operator terms state otherwise;
- After session start: Parking sessions that have started are generally non-refundable, except where required by law or where we or the operator agree otherwise (for example proven system error on our side);
- Operator penalties: Fines, penalty charge notices (PCNs), clamping, or towing costs issued by operators or authorities are not refundable by ParkApp unless we expressly agree in writing;
- Processing time: Approved refunds are usually returned within 5–10 business days, depending on your bank or card issuer.
To request a refund or billing review, contact bnawel248@gmail.com with your booking reference, date, and reason. Please contact us before initiating a chargeback so we can investigate; unjustified chargebacks may lead to account suspension.
7. Acceptable use
You agree not to:
- Use the Services unlawfully or in a way that harms others;
- Provide false identity, vehicle, or payment information;
- Attempt to bypass security, scrape data, reverse engineer, or overload our systems;
- Use the Services to facilitate fraud, money laundering, or unauthorised access;
- Resell or commercially exploit the Services without our written consent;
- Infringe intellectual property or privacy rights of ParkApp or third parties.
We may investigate violations and cooperate with law enforcement where required.
8. Intellectual property
The Services, including software, design, logos, text, graphics, and databases, are owned by ParkApp or our licensors and are protected by copyright, trade mark, and other intellectual property laws. “ParkApp” and related branding are our trade marks or those of our affiliates.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for personal or internal business use in accordance with these Terms. You may not copy, modify, distribute, or create derivative works except as permitted by law or with our written consent.
9. Third-party services and links
The Services may integrate with or link to third-party websites, maps, payment systems, parking operators, and platforms (including the UK National Parking Platform where applicable). We are not responsible for third-party content, availability, or practices. Your use of third-party services is at your own risk and subject to their terms.
10. Privacy
Our collection and use of personal data is described in our Privacy Policy, which forms part of your agreement with us. Please read it carefully.
11. Disclaimers
To the fullest extent permitted by law, the Services are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, error-free, or free from harmful components.
We do not guarantee availability of any specific parking space. Operator capacity, enforcement, and local events may affect parking. Nothing in these Terms excludes or limits warranties that cannot be excluded under applicable law (including the Consumer Rights Act 2015 where you are a consumer).
12. Limitation of liability
If you are a business user: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our total aggregate liability arising out of or relating to the Services or these Terms shall not exceed the greater of (a) the fees you paid to us for the Services in the 12 months before the claim, or (b) £100, except where liability cannot be limited by law.
If you are a consumer: You have legal rights under UK consumer law. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any matter that cannot be limited by law. For other losses, our liability is limited to the amount you paid for the relevant booking or service, except where a higher limit is required by law.
We are not liable for acts or omissions of parking operators, payment networks, or other third parties outside our reasonable control.
13. Indemnity
If you are a business user, you agree to indemnify and hold harmless ParkApp and its directors, officers, and employees from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Services, or violation of law or third-party rights, except to the extent caused by our negligence or wilful misconduct.
14. Suspension and termination
You may stop using the Services at any time. We may suspend or terminate access immediately if you breach these Terms, if required by law, or to protect the Services or other users. Provisions that by nature should survive (including payment obligations, liability limits, intellectual property, and governing law) will survive termination.
15. Governing law and disputes
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers resident in Scotland or Northern Ireland may also bring proceedings in their home jurisdiction where consumer law allows.
If you are a consumer, you may use alternative dispute resolution schemes where applicable. We are not obliged to participate in a particular scheme unless required by law.
16. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date shows when they were last changed. Continued use of the Services after changes take effect constitutes acceptance. For material changes, we will provide notice on the website or by email where appropriate.
